Workplace Health & Safety Legislation
WHS Legislation, Regulations and accompanying Codes of Practice place significant obligations on various persons in all workplaces.
Key features with regard to asbestos are:
- Any workplace building constructed prior to 31 December 2003, is required to have an up-to-date asbestos register conducted by a competent person. The register is to be reviewed at least once every five years.
- Any workplace structure or plant (constructed prior to 31/12/2003) undergoing demolition or refurbishment is required to be inspected for the presence of asbestos materials prior to commencement of such works.
- Any removal of more than 10m2 of asbestos material from a workplace or residential premises is required to be undertaken by a licenced asbestos removal contractor.
- A clearance inspection by an independent competent person is required following the removal of more than 10m2 of non-friable asbestos material. A clearance inspection and air monitoring is required for removal of any quantity of friable asbestos material.
